Fantasy Swimming Challenge - 2022 Bell Canadian Swimming Trials (April 5 - April 10, 2022)

Eligibility:​ OfficePools “2022 Bell Canadian Swimming Trials Contest” (the “Box Pool Contest”) is open to legal residents of Canada, who are eighteen (18) years of age or older, except that you must be nineteen (19) years of age or older if you live in British Columbia, New Brunswick, Newfoundland and Labrador, Northwest Territories, Nova Scotia, Nunavut, Ontario, PEI, Saskatchewan or Yukon; and legal residents of the United States (excluding all U.S. territories, including but not limited to Guam, U.S. Virgin Islands and Puerto Rico) who are twenty-one (21) years of age or older. Sponsors (as defined below), its subsidiaries and affiliates, and any other companies or agencies associated with this Contest are collectively referred to herein as the “Contest Entities”. Employees of the Contest Sponsors and their immediate family members (defined as parents, parents-in-law, children, siblings and spouse (including common law), regardless of where they reside), and any athlete participating at the 2022 Bell Canadian Swimming Trials, are not eligible to enter the Contest or win Contest prizes. Any other persons with whom such employees are domiciled are also not eligible to enter the Contest or win Contest prizes. VOID WHERE PROHIBITED.

Sponsors:​ The Contest is sponsored by Officepools.com Services Ltd., 88 E Pender St Unit 500, Vancouver, BC V6A 3X3, and Swimming Canada, 307 Gilmour St. Ottawa, ON  K2P 0P7, collectively the “Sponsors”.

Swimming Trials (2022 Bell Canadian Swimming Trials):​ As used herein, “Swimming Trials” means the 6 days of swimming races held by the Swimming Canada, in Victoria, British Columbia from April 5 to 10th, 2022. 

For Olympic Program events, there will be an “A” Final for all events, consisting of the fastest 8 Canadian athletes regardless of age. The next fastest 8 swimmers, Canadians born 2003 and earlier and up to 2 foreign swimmers including alternates, will make up the “B” Final. There will only be a single, open “A” Final for the 50 butterfly, 50 backstroke and 50 breaststroke. When the event is a time final, the fastest 8 Canadian swimmers, regardless of age, will advance directly to the “A” Final. For the Paralympic Program events, finalists will be determined utilizing the Canadian Paralympic Point System. A maximum of three (3) swimmers per sports class are eligible to advance to the Final.  Finals will be seeded by time. If there is a tie-by-point score in a specific event for swimmers with the same sports class, the fastest preliminary time will advance to Finals.  If there is a tie-by-point score in a specific event for swimmers with different sports classes, there will be a swim-off.  The swimmer with the highest point score achieved in the swim-off will advance to Finals. 

Agreement to Official Rules:​ By participating in this Contest, entrants agree to abide by the terms and conditions thereof as established by the Sponsors. Sponsors reserves the right to qualify all submissions and to reject any submissions that do not meet the requirements for participation as established by Sponsor.

Entry Period:​ ​The Contest will accept Picks beginning March 28, 2022, at 12:00 pm Pacific Standard Time up to 8:00 a.m. April 5, 2022, Pacific Standard Time (the “Entry Period”).

Picks received before or after the Entry Period are void. OfficePools computer server, on which the Contest is hosted, is the official time-keeping device for the Contest.​ 

How To Enter:​ To enter this Contest, you will need an authenticated OfficePools account (an “Account”). If you don’t already have an Account, simply visit OfficePools at https://www.officepools.com/accounts/signup/​. Creating an Account is free. By submitting your information, you agree to the Sponsor’s Web Site Use Agreement (https://www.officepools.com/site/terms​). If you do not agree to the Web Site Use Agreement, you cannot create an Account or participate in this Contest. After signing up for an Account, you must authenticate your Account by clicking on the link in the verification email that will be sent to the email address you provided. 

Once you are logged into your Account, you can click on the link to the Contest on the OfficePools.com homepage. After you have created a team name, you can start making swimmer selections for each race listed. There are 19 boxes that each represent a specific swim stroke and distance. Within each box are an equal amount of men and women swimmers to choose from. You must pick 2 swimmers from each box that you think will perform well in each final race. You may pick any gender or combination, and points are given based on how each swimmer selected performs in that specific event listed in the box. Picks must be submitted before the event begins on April 5th 8:00 a.m. PST.

Due to the Autosave feature, picks will be deemed submitted when you make your selections within the Contest interface. You may update and change your Picks before the swimming trials officially begins. The date and time of your last update and submission shall be deemed to be your submission date and time. Failure to make your pick(s) within the designated time period will be automatically scored as zero points. 

Limit one (1) set of Picks per person. ​ Anyone found to use multiple accounts to enter will be disqualified from participating in the Contest or winning Contest prizes. Any questions regarding the number of entries submitted or the owner of an entry shall be determined by Sponsor in its sole discretion, and Sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Contest. In the event of a dispute over the ownership of an entry, the entry will be deemed to have been submitted by the person in whose name the email account was opened. 

Normal internet access and device usage charges imposed by your online service provider may apply. Sponsor assumes no responsibility for the computer system, hardware, software or program malfunctions or other errors, failures, delayed computer transactions or network connections that are human or technical in nature, or for damaged, lost, late, illegible or misdirected entries; technical, hardware, software, electronic or telephone failures of any kind; lost or unavailable network connections; fraudulent, incomplete, garbled or delayed computer transmissions whether caused by Sponsor, the users, or by any of the equipment or programming associated with or utilized in this Contest; or by any technical or human error that may occur in the processing of submissions or downloading, that may limit, delay or prevent an entrant’s ability to participate in the Contest. Sponsor is not liable for any loss, injury or damage caused, whether directly or indirectly, in whole or in part, from downloading data or otherwise participating in this Contest. Sponsor reserves the right, in its sole discretion, to cancel this Contest for any reason, including if viruses, bugs or other causes beyond Sponsor’s control, unauthorized human intervention, malfunction, computer problems, phone line or network hardware or software malfunction, which, in the sole opinion of Sponsor, corrupt, compromise or materially affect the administration, fairness, security or proper play of the Contest or proper submission of Picks.

Scoring:​ The contestant’s primary objective is to earn as many points as possible by picking the swimmers they think have the best chance to win each of their individual ‘A’ Final races. Picks must be submitted before the first race on April 5, 2022. Each pick will contribute to the entrant’s overall point total based on their selected swimmer’s finish in the respective race according to the table below.

Selection of the Overall Points Prize Winner:​ At the conclusion of each competition day, points will be calculated for each entrant who has submitted their picks. At the conclusion of the Swimming Trials, the entrant with the most accumulated points will be eligible to win the Grand Prize. In the event of any ties, the following tiebreaker of the most first place finishes will be used. If any entrants are still tied a random Draw from among those still qualified will be utilized in order to determine a winner.

Selection of Random Draw Prize Winner: At the conclusion on the Swimming Trials a random draw will take place of all entrants to select an eligible winner of the Random Draw Prize.

Prizing:​ 

• The 1st Place Winner will receive 150,000 Marriott Bonvoy Points and $3,500 in Air Canada gift cards
• Random Draw Prize: Autographed Tokyo racing suit (includes shipping and professional framing)

Requirements and Notification of Prize Winners:​ The Prize Winners will be notified via email on or about five (5) business days after the end of the Contest. If the respective Prize Winner does not acknowledge acceptance of his or her prize within ten (10) business days after being notified that he or she is a Prize Winner, the prize will be forfeited.  For the Grand Prize, it will then be awarded to the entrant with the next highest accumulated points.  For the Random Draw Prize,  a re-draw will occur for the remaining eligible entries. In the event that there are no other Prize Winners, the Sponsor reserves the right to not award the prizing. All prizes are non-transferable and must be accepted as awarded.  There is no cash value.  The Grand Prize winner must be a Marriott Bonvoy member in order to receive the Marriott Bonvoy points.  Sponsor may require the Prize Winners to provide a copy of valid government-issued photo identification as evidence of age and identity and to sign and return an affidavit of eligibility and liability and publicity release, wherever lawful, as a precondition to award of the prize. If the Prize Winner fails to provide such identification and sign and return the requested documents to Sponsor in the time indicated by Sponsor, that Prize Winner may be disqualified, and the prize will thereafter be awarded to one of the other Prize Winners from the remaining valid entries using the  procedure specified above. The prize shall be delivered to the Prize Winner at the mailing address provided by the Prize Winner.

Privacy:​ By submitting an entry, entrants acknowledge and agree that any personal information that they provided will be maintained in accordance with OfficePools.com Services Ltd’s “Website Use Agreement”, which can be viewed here:  https://www.officepools.com/site/terms​. By participating in the Contest, you: (i) grant to the Sponsors the right to use your name, mailing address, telephone number, email address, user name, Private Team name, and gameplay information (including but not limited to Picks, scores, and standings) (“Personal Information”) for the purpose of administering the Contest, including but not limited to contacting and announcing the winners; (ii) grant to the Sponsors the right to use your Personal Information for publicity and promotional purposes relating to the Contest, in any and all media now known or hereafter devised, without further compensation unless prohibited by law; and (iii) acknowledge that the Sponsor may disclose your Personal Information to third-party agents and service providers of the Sponsor in connection with any of the activities listed in (i) and (ii) above. Sponsor will use the entrant’s Personal Information only for identified purposes and protect the entrant’s Personal Information in a manner that is consistent with the Website Use Agreement.

RELEASE:​ ENTRANTS AGREE TO RELEASE AND HOLD HARMLESS THE CONTEST ENTITIES AND THEIR RESPECTIVE SUCCESSORS AND ASSIGNS FROM AND AGAINST ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF PARTICIPATION IN THIS CONTEST. ENTRANTS AGREE THAT THE CONTEST ENTITIES AND THEIR RESPECTIVE SUCCESSORS AND ASSIGNS ARE NOT LIABLE FOR INJURIES, LOSSES OR DAMAGES OF ANY KIND ARISING FROM PARTICIPATION IN THIS CONTEST

AND ACCEPTANCE, POSSESSION AND USE OF ANY PRIZE. SPONSOR IS NOT RESPONSIBLE FOR ANY TYPOGRAPHICAL OR OTHER ERROR IN THE PRINTING OF THE OFFER OR ADMINISTRATION OF THE CONTEST OR IN THE ANNOUNCEMENT OF THE PRIZE. NO ENTRIES WILL BE RETURNED. ALL ENTRIES BECOME THE PROPERTY OF THE SPONSOR.

DISPUTES EACH ENTRANT AGREES THAT​:

TO THE EXTENT PERMISSIBLE BY LAW ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION

ARISING OUT OF OR IN CONNECTION WITH THIS CONTEST, OR ANY PRIZES AWARDED, SHALL BE

RESOLVED INDIVIDUALLY, WITHOUT RESORTING TO ANY FORM OF CLASS ACTION, EXCEPT THAT YOU MAY ASSERT CLAIMS IN SMALL CLAIMS COURT IF YOUR CLAIMS QUALIFY;

1. ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THIS CONTEST, BUT IN NO EVENT ATTORNEYS' FEES; AND
2. UNDER NO CIRCUMSTANCES WILL ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL, AND CONSEQUENTIAL DAMAGES, AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED.

JURISDICTION:​ ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES, OR THE RIGHTS AND OBLIGATIONS OF ENTRANT AND SPONSOR IN CONNECTION WITH THE CONTEST, SHALL BE GOVERNED BY, AND CONSTRUED IN ACCORDANCE WITH THE LAWs OF THE PROVINCE OF BRITISH COLUMBIA, PROVIDED THAT NOTWITHSTANDING THE FOREGOING, IN THE CASE OF CANADIAN RESIDENTS, APPLICABLE LAWS IN CANADA MAY REQUIRE THAT THE LAWS OF THE CANADIAN JURISDICTION IN WHICH YOU RESIDE APPLY INSTEAD, IN WHICH CASE THE LAWS OF THAT JURISDICTION WILL APPLY.
